Individuals under house arrest who leave their residence without authorization will be criminally liable for escape, and convicts who are absent at the time of sentencing may be declared wanted immediately after the sentence is pronounced. The legislative changes were approved by the Government at the initiative of the Ministry of Justice, reports IPN.
According to the MJ, in the case of convicts who are absent at the time of sentencing, the court may ex officio order the search, as well as the application of the note. Authorities argue that this will eliminate the interval in which the convicted person could try to hide or leave the territory of the Republic of Moldova.
At the same time, it is planned to extend electronic monitoring in the case of individuals required not to leave the locality or the country, as well as those provisionally released under judicial control. In addition, the notion of a “consemn” is introduced in the Penal Procedure Code, with two distinct forms: the information “consemn” and the border “consemn”. These will be integrated into state information resources, to facilitate the location of the person and streamline inter-institutional communication.
According to the Ministry of Justice, the amendments aim to strengthen the mechanisms for enforcing judicial decisions and preventing cases where convicted persons avoid carrying out criminal penalties.
