State paid over €162,000 damages as a result of ECHR convictions

The Republic of Moldova last year paid €162,200 damages as a result of ECHR convictions. During 27 years, since the Republic of Moldova ratified the European Convention on Human Rights, the state paid applicants almost €23 million damages. The data were analyzed by the Legal Resources Center, which presented the analytical note entitled "The Republic of Moldova at the European Court of Human Rights in 2024".

Daniel Goinic, director of the Human Rights Program, told a news conference hosted by IPN that the amount of compensation paid by the state since 1997 until 2024 would have been enough to reform the penitentiary system.

"To build a new penitentiary, to efficiently manage the work of the country's penitentiaries or to pay a few hundred thousand pensions or average salaries in the economy," said Daniel Goinic.

As many as 812 violations were found by the 616 judgments pronounced during 27 years. Most frequently, the Republic of Moldova was condemned for violating Article 6 of the Convention – the right to a fair trial.

 "Article 6 is directly related to the work of the judge. Everything that happens in court is related to the right to a fair trial in accordance with the standards of the Convention. We have 251 such violations or 30% of the total number," noted Daniel Goinic.

The right to freedom and security is another frequently violated right. It is the criminal investigation phase, namely, the activities of police officers, prosecutors, the National Anticorruption Center and other law enforcement agencies. As for the violation of the article that provides for the prohibition of ill-treatment and torture, it is broadly related to the poor detention conditions.

"It is no secret to anyone that Penitentiary No. 13 is a huge problem for Moldovan society, especially for prisoners, where their rights are violated. And this is due to poor detention conditions, bad medical services, etc.," said the expert.

In 2024, the European Court of Human Rights registered 363 applications against the Republic of Moldova, by 44% fewer than in 2023. At the same time, 17 judgments in Moldovan cases were pronounced last year, the figure being by 30% lower than in 2023.

In 2025, it will be 15 years since the Legal Resources Center from Moldova started to publish a summarized report on the convictions against the Republic of Moldova passed by the European Court of Human Rights.
