Prosecutors suspended from office will be able to work in public or private sector

Prosecutors suspended from office in connection with the start of a criminal investigation against them will be able to perform activities in areas of the public or private sector. The condition is that these activities should not be directly or indirectly related to the duties of a prosecutor. The period of suspension from office will not constitute the seniority in the position of prosecutor and will be taken into account in the general length of service. A draft law to amend Article 55 of the Law on the Prosecutor’s Office was approved by the Cabinet, IPN reports.

During the period of suspension, the suspended prosecutors will be able to hold another public post in accordance with the Law on the Civil Service and the Status of the Civil Servant, or to carry out activities in the private sector. That is, to be able to obtain income based on individual employment contracts or other forms of cooperation with commercial companies or other entities that carry out their activities exclusively in the private sector, and also to carry out entrepreneurial or arbitration activities. Any activity performed during the period of suspension must not affect the prestige and reputation of the Prosecutor’s Office.

The prosecutor who will not be found guilty of the charges will have all the previous rights restored, including the seniority in office.

Given that the draft law aims to bring the normative framework into accordance with the Constitutional Court’s decision, it is proposed that the amendments that will be made through this legislative initiative should enter into force on the date of publication in the Official Gazette. But first they have to be adopted by Parliament.
