The changes adopted by Parliament to the Law on the Constitutional Court (CC), concerning the immunity of judges, haven’t been promulgated by President Nicolae Timofti, IPN reports. On May 8, the head of state sent the amendments back to Parliament for reexamination. Under the amendments, Parliament will be able to discharge the constitutional judges in case of ‘loss of confidence’.
In the letter addressed to Parliament, Nicolae Timofti underlined the necessity of respecting the constitutional provision concerning the holding of appointment for life by judges. The head of state formulated a series of objections as regards the legislature’s right to remove the Constitutional Court judges from post and the reasons based on which this can be done.
Nicolae Timofti considers that in order to improve the work of the CC, it is very important for the legislation to clearly and exhaustively stipulate the generally accepted limits of the Court’s powers so that its decisions are predictable.
The amendments have earlier aroused reactions on the part of European officials, who said that the provisions can affect the rule of law norms and violate the basic human rights.
The bill was passed by the votes of the Communist and Liberal-Democratic MPs on May 3.
