Prosecutor General Alexandr Stoianoglo requested the Constitutional Court to establish the constitutionality of the President’s September 6 degree to discharge Dumitru Pulbere from the post of member of the Superior Council of Prosecutors, IPN reports.

Alexandr Stoianoglo also asked the Court to determine the constitutionality of the expression “and also the age of at most 65” from the law on the prosecution service that was incorporated into the text by the amendments made by Parliament on August 24, 2021.

Furthermore, the Constitutional Court is requested to pronounce on the constitutionality of the procedure for making the law of August 24, 2021 by which the law on the prosecution service was amended and supplemented.

“The Prosecutor General’s Office considers it is pressingly needed to suspend the effects of the challenged provisions so as to conserve constitutional order, the independence of SCP, the irremovability and stability of the mandate of the members of this self-managed body as an authority with a basic role in the exercise of power in the state given the weight of the power offered by the supreme law,” the institution said in a press release.

The former president of the Constitutional Court Dumitru Pulbere became a member of the Superior Council of Prosecutors in February 2018 following a decree signed by the then President Igor Dodon. On September 6, President Maia Sandu issued a decree by which the mandate of Pulbere was terminated.
