Secretary of state at the Ministry of Justice Nicolae Eșanu said that despite the made efforts, the Ministry didn’t manage to persuade society that justice is not only done, but is also seen after being done. The issue was developed in the talk show “Country” on Vocea Basarabiei TV channel, IPN reports.

“We can have the best judges in the world, who would adopt the best decisions, but when the people perceive justice as non-independent, it means we have a problem,” stated Nicolae Eșanu.

According to him, besides the efforts made to change things in the justice sector, greater attention should be devoted to communication. “We do many things, but very seldom speak about them so as to show what we have done,” noted the secretary of state. In particular, Nicolae Eșanu said the Republic of Moldova managed to implement the most innovatory elements in justice.

He admitted that there are yet shortcomings in the justice sector and some of these are notorious. Nicolae Eșanu said the appointment of judges for a so-called trial period of five years, as it is provided in the Constriction, is the biggest flaw. “According to experts, when the judge does not enjoy stability in the held post, is not named for life and when taking a decision should think twice so that this decision does not influence his career is one of the biggest problems,” stated the jurist.

He also said that the current political class of Moldova has no legal possibility of influencing the fate of a judge as there is a common mechanism for appointing judges within which the Superior Council of Magistracy has a decisive say. “The President or the Speaker of Parliament can reject the candidate only once. If the Superior Council of Magistracy proposes this again, the President is obliged to name the candidate to post,” explained the secretary of state.
