New minister of justice says legislation on preventive arrests will be treated as priority

The amendment of the legation on preventive arrests is one of the priorities of the new Minister of Justice Alexandru Tanase as this is the most serious problem that generates the dissatisfaction of judges and ordinary people, according to him. The minister developed the issue in the talk show “Emphasis on today” on TVR Moldova channel, IPN reports.

Alexandru Tanase said this is a problem that distorts the fundamental principles of a fair trial. “I think we will suggest a series of legislative amendments that would rapidly remedy the situation,” stated Alexandru Tanase. He expects that the number of preventive arrests in six-seven months will reach the rate of 2007-2009.

The minister noted that the issue was discussed with members of the Superior Council of Magistracy, who are dissatisfied with the situation created as to preventive detention. “It is very difficult, but not impossible to intervene in the decision-making process of a judge. This is illegal. No one, even the SCM, can instruct a judge to be attentive when deciding about the preventive arrest,” stated Alexandru Tanase.

He said that to solve this problem, the Superior Council of Magistracy will adopt decisions on the specialization of judges in Chisinau municipality so that the prosecutors could not choose the judges to whom they would go for preventive arrest warrants. “We should be sure that the random distribution of cases is indeed random and there are conditions in courts that would prevent interference and pressure on judges,” stated the minister.
