The European Court of Human Rights could pronounce a judgment against the Moldovan Government if the dependence of some judges in Moldova further persists, Vitalie Nagacevschi, president of the “Lawyers for Human Rights” organisation told the meeting of the network of journalists “European Reporter” on Friday, September 7. Nagacevschi says that a signal for a potential condemnation could be considered the partly dissenting opinion of a Maltese judge in the case of “Flux v. Moldova”, who voiced views on the pathology of the administration of justice in Moldova. And, Nagacevschi says, dissenting opinions may represent landmarks for future judgments of the Court. Nagacevshi stated that, in addition, there is a judgment pronounced by the German state of Thuringia, which attests the subordination of the judiciary to the government. Both national and foreign experts consider that Moldova is failing to guarantee full judicial independence, a commitment assumed towards the Council of Europe and stipulated by the Moldova-EU Action Plan.
