Local Public Administration Ministry clueless about Chisinau's heat compensations regulation
The Local Public Administration Ministry (LPAM) cannot voice its stance, as yet, concerning the legality of the decision of the Chisinau Municipal Council as to the Regulating of compensating dwellers' heating charges. This is the answer delivered Thursday by LPA deputy minister Sergiu Tatarov to the interpellation of Moldova Noastra Alliance MP Alexandru Oleinic, Info-Prim Neo reports.
Sergiu Tatarov has reasoned on the Parliament's floor the CMC decision has not been officially published yet, not being signed by the CMC chairman, neither counter-signed by CMC secretary, as the law provides. Tatarov argued this is the reason why the decision has not been presented to the LPAM to check up its legality, but assured the Ministry will do so when it has the official decision.
According to the deputy minister, the CMC is shortly to consider modifying the new regulation. Sergiu Tatarov could not confirm the MP's estimation that applying the regulation will 1.3 billion lei, but has specified the money is to be taken from the municipal budget, under the law.
Alexandru Oleinic has pointed out that the law prohibits local councils to adopt decisions without specifying the source of covering the expenses. The AMN parliamentarian has concluded the regulation adopted by the CMC is “a illegal decision, without financial backing, a populist decision adopted in the wake of the 2009 parliamentary elections.”
The deputy has asked the LPAM to present new information, after the CMC decision is enacted.
The CMC regulation on granting nominal compensations for heating comes to replace the present mechanism when the City Hall compensate the charge for everybody. When asked by Info-Prim Neo, leaders of CMC factions called the new regulation a good one, in general. Some other councilors stated the regulation cannot be enforced. All of them acknowledged the municipality did not have the money to apply the regulation.
