The termination of the work contracts with teachers reaching retirement is not a violation of the Constitution. In a meeting on April 23, the Constitutional Court decided that the relevant amendments made to the Labor Code are compliant with the supreme law.
“I do not agree with the decision, but we will have to comply. As far as I understood, the state can impose restrictions on certain posts. The law says that we must offer the young people the possibility of working, but I don’t think that we must discriminate against the elderly people this way,” MP Sergiu Sarbu, who filed the challenge to the Constitutional Court, stated for IPN. He also said that he will put forward a legislative initiative by which to ensure the retired teachers’ right to a decent living by receiving salary for their work.
The amendments to the Labor Code took effect last June. Under them, the individual work contract signed with a teacher or a worker from the area of science and innovation is terminated when the old age pension is set. The changes were proposed by the Ministry of Education.
