The honorarium of bailiffs will not exceed 500,000 lei, regardless of the value of property and possessions sequestrated in favor of the creditor. The Government approved a legislative initiative in this respect, IPN reports.
Under the Execution Code, the bailiffs’ honorarium now represents up to 10% of the value of the sequestrated property and possessions. In some cases, the honorarium can be exorbitant.
Not long ago, the Economic Court allowed levying of a debt of over 700 million lei from SA Termocom in favour of the thermoelectric power plant CET-2. The honorarium of the bailiff was 7.5 million lei. SA Termocom issued a communiqué, saying that if the honorarium is paid fully, the given sum will be taken into account when raising the heat charge. The bill approved by the Government obliges the bailiff to keep a register of the measures taken to implement the court decisions.
