Iulia Deleu, who founded the company “Iunitex”, said she became the victim of the illegalities of oligarchs and functionaries from the judicial system. The founder, who has developed a business with big difficulties and large costs during 20 years, is the target of a raider attack staged by oligarchs supported by the judiciary system.

In a news conference at IPN, Iulia Deleu said that in 2013 her company, as the beneficiary, concluded a contract with ABC “Gurmandis” SRL, as the investor. It was a contract for investment in construction, based on which the investor pledged to transfer €1 million to the beneficiary, while the beneficiary pledged to erect a shopping center in Chisinau municipality and to transfer the first floor and the basement and also ½ of the land adjoining the building to the investor.

Iulia Deleu said that under the investment contract, the sides agreed that if financing is needed for completing the construction works, the investor will provide an extra €300,000 on condition that an interest rate of 10% a year is paid. There are banking documents showing the investor transferred €1 million and €200,000 in extra financing to the beneficiary at a time when this pledged to provide €300,000.

“The investor, pursuing evil goals, intentionally didn’t transfer all the additional financing, but six months after the building was made available for use and the agreed share was signed over and nine months after the works were executed, the investor invented that the difference in the additional financing represents the cost of works that were to be performed by the beneficiary, but were carried out by contractors of the investor,” stated Iulia Deleu.

According to the e founder of “Iunitex”, in the autumn of 2015 the investor decided to transfer the sums paid to its contractors to the beneficiary and took unfounded actions to execute the mortgage right and to cause the bankruptcy of  “Iunitex” so as to dispossess this of the erected building. Based on the June 7 judgement passed by the Chisinau Appeals Court, the judges gave the go-ahead to the offenders to dispossess “Iunitex” of the building and to transfer it to “Gurmandis” so that this could sell it and use the obtained money to clear the debt and fulfil the obligations deriving from the investment and mortgage contracts.

Alexandru Banari, president of the association “Justete”, said we are witnessing defective justice. “I consider the Chisinau Appeals Court passed an evidently illegal judgement as there was presented no evidence that wouldn’t have been examined by the first court. But the role of the appeals court is to examine the legality of the decisions taken by the first court, the circumstances, the correct implementation of the law, the conclusions,” he stated.

The chairman of the 1992 War Veterans Association “Tiras-Tighina” Anatolie Caraman said he examined the documents of “Iunitex” because he cannot remain indifferent to such illegalities. “Iunitex” asked for €300,000, but they (Gurmandis) gave only €200,000 and spent €100,000 lei so as to have a reason for filing the lawsuit. It is a stratagem. And later the court dispossessed “Iunitex” of the building,” he stated, adding this is a raider attack.
