ECHR to Examine the Case of the Peasants from Dubasari Region
The European Court of Human Rights (ECHR) decided to examine urgently the land owners’ application, whose rights to farm their lands and harvest the crop from the lands controled by the authorities from Tiraspol are infriged.
According to the Promo-Lex Organization, The Court from Strasbourg decided to apply the article 41 and 42 from the ECHR regulations. According to the article 41 the Court can decide to examine some applications in an urgented regime. According to the art.40, if needed, the Court comunicates urgently to the State the requests of the defendant.
The claims have been already comunicated to the Governments of the Russian Federation and the Republic of Moldova, that will have to present in the shortest time possible their observations upon the aspects regarding the violation of the petitioners’ right of property.
In the context of the peasants’ problem from the Dubasari district, Ion Manole, the president of the Organization, declared that the Russian Federation set up a trap by imposing through authorities from Tiraspol the signing of a the so called ‘temporary land usage’ contracts with the separatist authorities that are in fact private property of the peasants from the Dubasari district.
In the autumn of 2004, several economic units from Dubasari district sent to ECHR individual complaints, invoking the article 13 from the European Convention of Human Rights and the 1st article of the Aditional Protocol. In the period between 2005 – 2006 ECHR registerd nearly 2000 petitions from the land owners from the Dubasari disrict.
At the end of the last week, Grigore Poilicinschii, the head of the Dubasasri district administration, announced that after several negotiations, the administration of the district came to an agreement with the Transnistrian authorities that includes concluding contracts with the respective authorities, on the basis of which will be given certificates of free circulation and cultivation of the agricultural lands placed on the roadway Rabnita-Dubasari-Tiraspol, controled by the regime from Tiraspol.
