Dorin Chirtoaca: Central authorities managed to assume control of some municipal properties without consent of Chisinau Municipal Council
General Mayor of Chisinau Municipality, Dorin Chirtoaca, says that during the period before he was elected as mayor of Chisinau, the central authorities managed to assume control of some municipal properties without Chisinau Municipal Council’s consent (CMC).
Chirtoaca mentioned at a news conference that such situations when the state tries by laws or decisions by the Government to assume control of some of the Municipality’s properties could exist in the future, too.
He states that a decision by the Government has been recently issued stipulating that the administration of the Creation Centre “Satul Moldovenesc- Buciumul” (Buciumul Moldovan Village) was to be conveyed to the Ministry for Culture, without a CMC preliminary approval in this respect.
The Government’s decision on setting up the state-owned enterprise “Satul Moldovenesc- Buciumul” was endorsed on July 2 this year. The founder roles were given to the Ministry for Culture who was supposed within 3 months to sanction the acts of setting up and conveying the property to its management. It is the same, according to the mayor, when it comes to the lots meant for METRO’s construction.
As such possibilities are discussed at the moment with regards to the Wastewater Treatment Station, Dorin Chirtoaca invokes lots of talks to clarify these aspects. “As you can see, when it comes to major investments, one resorts to the way of getting out of the local administration’s control the aspects, which are the most attractive from the investment point of view”.
The General Mayor outlines that, under the law, nothing can be transferred from the Municipality’s property without the CMC consent.
Economic expert Veaceslav Ionita has recently advised the local authorities to appeal to the Constitutional Court the law on administration and denationalisation of public property, which is quite probable to be declared unconstitutional, through the Agency of an MP. According to him, the law envisages the inclusion of Termocom JSC in the list of facilities that cannot be privatised, contrary to the supreme law and to the principle of the local autonomy. Ionita says that the central authorities can ban only the privatization of the property that belongs to them, but not that of the local authorities.
