Judge of the Chisinau Appeals Court Domnica Manole said the Superior Council of Magistracy seriously violated the law when it decided that she should be dismissed. She noted she is harassed because of her activity and her position. The judge made such statements in the program “Important” on TVC 21 channel, IPN reports.
“This harassment is revenge taken by the system. I had a principled position as a member of the Disciplinary Board. For example, I asked to disciplinarily punish five judges of the Supreme Court of Justice for disciplinary deviations. They told me then that they will take revenge. There were also general assemblies of judges where I leveled harsh criticism at the system, while the decision on the referendum was taken as a motive,” stated Domnica Manole.
The judge noted that attempts were made to make her keep silent. “They told me several times what I should do and how I should act. But I cannot give up my principles concerning justice. In the case of the referendum, I was requested by decision makers of the judicial administration to take a decision in favor of the CEC. But I acted in accordance with the law. I didn’t denounce them because I had only five days to take a decision in his case and I had to work 20 hours of 24,” she said.
Domnica Manole also said that the Superior Council of Magistracy broke the law because it didn’t have the right to take such a decision in the absence of a decision of the Disciplinary Board. “There was a similar case, of judge Doga, ex-president of the Chisinau Appeals Court. The Superior Council of Magistracy also decided in favor of his dismissal, bypassing the Disciplinary Board. Afterward, the Supreme Court of Justice annulled this decision,” she stated.
Recently, based on the appraisals of the Security and Intelligence Service, the Superior Council of Magistracy ruled that the judge of the Chisinau Appeals Court Domnica Manole is incompatible with the post of judge. The Council will request President Igor Dodon to dismiss her from post. Last April, Domnica Manole passed a judgment by which the Central Election Commission was obliged to hold the constitutional referendum initiated by the Platform “Dignity and Truth”. The judgment was later quashed by the Supreme Court of Justice.
