CC rejects Shor Party’s application concerning state of emergency

The Constitutional Court (CC) dismissed as inadmissible the application by which the Shor Party requested to determine the constitutionality of the Parliament decision to extend the state of emergency, IPN reports.

Application author, MP Marina Tauber said there was no reason for prolonging the state of emergency given that the Government, the Parliament and all the other state institutions work as usual and can take any measure in legal conditions and during the repaired periods of time. The Parliament decision to extend the state of emergency is abusive and violates the principle of separation of powers in the state.

Given the equality of votes on the consideration of the submission, the Court decided to stop the examination of the request to determine the constitutionality of the Parliament decision to extend the state of emergency of February 2, 2023.

The Court’s decision is definitive and cannot be challenged. It takes effect when it is adopted and is published in the Official Gazette.
