The Constitutional Court’s decision concerning the powers of an interim Government caused controversy among the MPs. Some of the MPs say this decision does not generate a solution to the political crisis witnessed in Moldova. Others say the CC decision stipulates important details that offer the interim Government functionality through the agency of the secretaries of state, IPN reports.
In its decision, pronouncing on President Maia Sandu’s request, the CC held that the ministers in an interim Cabinet cannot be replaced, but the secretaries or state and heads of governmental agencies can be replaced.
“It was said that as there were provided particular solutions in 2013, the Court maintains those solutions. As to the international treaties, the Court held that it is a matter of interpretation of the law, while the Court interprets not the law, but only the Constitution. The ball is now in the Parliament’s court,” PAS MP Sergiu Litvinenco stated in the program “Natalia Morari’s Politics” on TV8 channel.
The Socialists said that by the March 4 decision of the Court, the presidential intuition’s jurists received one more blow after the CC earlier ruled that Parliament cannot dissolve itself and after it declared the presidential decree to nominate Natalia Gavrilița as Prime Minister again unconstitutional.
“If you want to replace the ministers, come with a governmental team and a good program and persuade Parliament. The Court said the Government can replace secretaries of state so that the interim Cabinet is functional during the crisis,” stated Vlad Batrîncea.
Pro Moldova president Andrian Candu said the CC judgment does not solve the political crisis as the political stalemate can be broken only by a dialog between the parliamentary groups and the President.
“This decision only clarifies particular aspects. At the moment, there is no conflict between the presidential administration and Parliament. It is a conflict between the presidential institution and the Constitution. The President must obey the Constitution and initiate consultations with the parliamentary groups,” stated Andrian Candu.
The PPPDA MPs do not think the CC decision can help solve the crisis as the country needs a Government with full powers.
“It needs a Government that would deal with the pressing problems faced by the people. We should have discussions. In a parliamentary republic, the solution is in Parliament. The President is a referee. This should only assess the state of spirit in Parliament, but the final solution comes from Parliament,” stated Vasile Năstase.
The CC recently held that the President is obliged to initiate consultations with the parliamentary groups so as to reach a compromise over the candidate for Prime Minister. For now, such consultations haven’t been held. President Sandu is having discussions with representatives of civil society so as to consider methods of overcoming the political crisis in Moldova.
