The provisions of the bill on the consumers’ right to conclude contracts are important and are aimed at instituting an improved legal framework for protecting consumers from the abuses committed by traders, but the main principles of legislation are being violated by the promotion of this bill as separate law. Such a conclusion was formulated by experts of the Center for Analysis and Prevention of Corruption (CAPC), who appraised the bill from the perspective of human rights.

CAPC expert Radu Jigau, in a news conference at IPN on November 24, said the authors of the bill didn’t take into account the fact that the national legislation contains already regulations that protect the consumers when these sign contracts.

According to the expert, the exiting legal framework lays down norms concerning the recalling of goods and services such as the relevant provisions of the Civil Code and the provisions of the Law on Abusive Clauses in Contracts Signed with Consumers of December 2011, which puts into practice provisions of the European Directive 93/13/CEE.

Radu Jigau said these legal norms certainly should be improved and updated to the provisions of the Firective, but in a way that would ease the unform implementation

Directivei, însă într-un mod în care să uşureze aplicarea uniformă, să înlăture dubla reglementare şi excesul de reglementare. Or, în opinia sa, toate reglementările din actul legislativ expertizat s-ar fi putut încadra armonios în prevederile Legii privind clauzele abuzive în contractele încheiate cu consumatorii, precum şi în Codul Civil.

Altminteri, proiectul ar corespunde în principiu cu prevederile Constituţiei RM, Convenţiei pentru apărarea drepturilor omului şi a libertăţilor fundamentale, Directivei  europene cu privire la drepturile consumatorilor şi altor acte internaţionale. De asemena, expertiza nu a scos la iveală vreo deficienţă în proiectul legislativ care ar fi făcut obiectul sesizării la Curtea Constituţională sau la CEDO

Expertiza a fost realizată în cadrul implementării proiectului „Armonizarea legislaţiei cu standardele internaţionale în domeniul drepturilor omului”, susţinut financiar de Apărătorii Drepturilor Civile din Suedia.
