€90,000 for representing state in dispute with Komaksavia Airport Invest Ltd

The Cabinet approved the allocation of €90,000 to two foreign companies and a Moldovan law firm that will represent the state in courts in Sweden in the lawsuit filed by Komaksavia Airport Invest Ltd against the Republic of Moldova, IPN reports.

The state interests will be represented by the consortium consisting of SALC Advokatbyra AB (Sweden), SLV Legal Inc. (U.S.) and the law firm “Bivol Soțchi & Partners” (Moldova).

The director general of the Public Property Agency was empowered to sign, in the name of the Government, the €90,000 legal assistance contract with the two foreign companies and the law firm of Chisinau and other necessary documents.

In May 2020, Komaksavia Airport Invest Ltd filed a lawsuit against the Republic of Moldova to the Arbitration Institute of the Stockholm Chamber of Commerce over alleged violation of the provisions on the promotion and protection of investments and the expropriation of the agreement between the Government of the Republic of Moldova and the Government of the Republic of Cyprus on the reciprocal promotion and protection of investments.

In August 2022, the Arbitration Institute of the Stockholm Chamber of Commerce rejected the suit filed by Komaksavia Airport Invest Ltd against the Republic of Moldova, awarding over €216,000 to Moldova in court costs.

In November 2022, Komaksavia Airport Invest Ltd challenged the Arbitration Institute’s decision in the Svea Court of Appeal in Sweden. In April 2023, the Svea Court of Appeal informed the Ministry of Justice of Moldova about the challenge filed by Komaksavia Airport Invest Ltd against the Republic of Moldova. As a result, the Moldovan authorities launched a contest to choose the legal representatives in this dispute.
