What one needs to know before adopting children

The adoption process in the Republic of Moldova lasts for an average of six months. The Ministry of Labor and Social Protection on its website posted the depersonalized lists of children, both for national adoption and for international adoption. These lists include children whose parents died, were deprived of parental rights, are subject to judicial protection measures, were listed missing without a trace, and abandoned children. 

In a response to an inquiry made by IPN, representatives of the Ministry of Labor and Social Protection provided details about how the adoption process has evolved in Moldova and about the conditions that adoptive parents must meet.

According to the quoted source, the adoption procedure is individual. The duration depends on the period during which the required documents are provided, but also on the possibility of matching an adopter with a child. The issuance of the visitation permit and the period of entrustment of the child to the adopter's family last from 60 to 90 days.

The application for approval of adoption in court is examined within 10 working days, and the court's decision becomes final also in 10 working days.

Eligible to adopt a child are considered to be persons who reached the age of 25 and are fully competent. At the same time, the potential parent must be at least 18 years older than the child they want to adopt. The court can also accept, in some cases, the difference of 16 years. The maximum age difference can be 48 years.

Couples who want to adopt a child are only allowed to do so if their marriage was registered at least three years earlier. It is enough for only one of the spouses to be at least 25 years old.

In an applicant for adoption has a particular degree of disability, this does not constitute an impediment to adoption, as long as the state of health does not prevent the fulfilment of parental obligations.

Foreign citizens who wish to adopt a child domiciled in Moldova can submit applications only through foreign organizations in the receiving state, accredited and registered under the law. Foreign citizens who have been in Moldova for at least 2 years can apply for international adoption through foreign organizations and through the central authority in the field of adoption.

The adoption application indicates the requests, but also the reasons why a person or a couple wants to adopt a child. Adopters must also meet the moral guarantees and material conditions necessary for the multilateral and harmonious development of the child. In the application, applicants for adoption must indicate the age of the child, the sex and the number of children they wish to adopt.

The adoptive parents are included in the child's birth certificate and have the rights and obligations of biological parents.

There are cases when the adoption can be declared null and void by the court. This happens if the adoptive parents died or if the child was adopted on the basis of false documents or without the consent of the biological parents.

If it was not possible to adopt a child until the child reaches the age of 18, the state undertakes to protect the child and gradually guide him or her to the transition to an independent life. Young people left without parental protection who continue their studies receive social allowances and enjoy advantages when they apply to an educational institution.
