The constitutional provision concerning the election of the head of state kills democracy and the Constitution should be amended so that the head of state could be elected, constitutional law expert Vitalie Catana said in the program “Pahomi” on Realitatea TV channel, IPN reports.
“There are many years since the given constitutional provision has generated political crises. We witness abnormal situations when we are being launched at abroad as well. We plead for a normal democracy, but this provision is nor democratic,” stated Catana.
The expert noted that he is for a parliamentary republic. “The head of state must be elected by Parliament, while the political parties should assume responsibility. It is now not opportune for the head of state to be elected directly by the people. In the current conditions, there is a danger for a discredited person, with a lot of money, to become head of state, as it happened at the mayoralties of Orhei and Balti,” said the expert.
Vitali Catana considers the referendum is the most justified method for overcoming the crisis related to the presidential elections. “The solution to consult the people is a correct one. Parliament should choose the head of state by a qualified majority of votes, which is 50+1 vote,” he stated.
During the negotiations on the formation of the Alliance for European Integration 3, the leaders of the pro-European parties agreed to initiate the procedure for amending the Constitution by referendum so that Parliament could elect the head of state by 50+1 vote of the 101 votes, instead of 61 votes. The Constitutional Court already endorsed this initiative.
