Both the chairman of the Constitutional Court (CC) Dumitru Pulbere and constitutional judge Victor Puscas, who demanded that the chairman should resign, are right in a number of respects, political analyst Viorel Cibotaru stated for Info-Prim Neo, adding debates on what is appropriate for a CC judge may follow.
Viorel Cibotaru said that on the one hand, it is unanimously accepted that the constitutional judges should refrain from making comments or political interpretations as this is outside their remit. On the other hand, the statement made by the Constitutional Court chairman is an opinion that has the right to exist, but is ‘painful’ for the current political class because it condemns the non-observance of the Constitution and exerts pressure on the politicians.
According to the analyst, Dumitru Pulbere ignores the code of conduct and makes statements that he considers important in the current situation, assuming a certain risk that threatens his career. “He said that if he is banned from examining certain documents, he is ready to withdraw from the discussions in accordance with the regulations of the Constitutional Court,” said Viorel Cibotaru.
As to Liberal MP Victor Popa’s assertion that Dumitru Pulbere is politically biased, Viorel Cibotaru said he does not believe that the interpretations of the CC chairman are strictly within the narrow views of a party or another. “This is the reflection of a stiff political battle. I think the statement should be regarded as a fact as, if he decided to speak, he probably had serious reasons to do so. However, the right to free expression is above the limits of a deontological code,” said Viorel Cibotaru.
Dumitru Pulbere said earlier that the Parliament of Moldova should be dissolved by September 28 if the head of state is not elected. After such an assertion, Victor Puscas said that the CC chairman should resign as he misused his power.
