President Nicolae Timofti cold nominate Ion Sturza as a candidate for premiership the second time too, if this is not voted in by Parliament by the first attempt, former chairman of the Constitutional Court Victor Puscas said in an interview for Radio Free Europe. He noted that this could be done for the reason that other arguments are gathered or the government program and list of candidates for minister are announced and the candidate can be nominated the second and third time if there is enough time, by January 29, IPN reports.
“On January 29, if a Prime Minister is not appointed and we do not have a Government, the head of state is obliged to dissolve Parliament. He presents the circumstances that lead to the dissolution to the Constitutional Court, which is examining them. Parliament is dissolved by the President’s decree and early legislative elections are announced within two months,” stated Victor Puscas.
As to the request of the 14 MPs who left the Party of Communists to verify the constitutionality of the President’s decree to nominate the candidate for premiership, Victor Puscas said the head of state has the right to choose a candidate and the consultation of the parliamentary groups does not oblige him to comply with their views. “The Constitution does not define particular conditions that the candidate for Prime Minister must meet. Thus, the President is free to choose the candidate,” said the ex-chairman of the Constitutional Court.
According to him, the 14 MPs inquire why the head of state didn’t consult them too. “The problem is that the Constitution, the Parliament’s Regulations and the Law on the Status of MP do not provide for the formation of additional factions of MPs. The Parliament’s working bodies - the parliamentary groups - are constituted during the first ten days. If some of the MPs leave the parliamentary groups, they do not have the right to join other groups if only after six months. These issues are rather clearly regulated,” he stated.
Victor Puscas also said that the situation in Moldova is now deplorable and it’s evident that the development direction is not the most correct. That’s why the head of state will look for a personality, a known person who will be able to solve the problems.
