The Cabinet approved the regulations of the interdepartmental commission for the financial compensation by the state of the damage caused by offenses. The commission will consist of three members who will represent the Ministry of Justice, the Ministry of Finance and the Ministry of Health, Labor and Social Protection. It will examine the applications submitted by victims of offenses within 30 days of the presentation, IPN reports.
The commission will decide who to provide the state compensation to and in what amount. It can refuse to provide the compensation or can suspend the examination of the application. The examination can be resumed if the absent documents are presented or other reasons for which the examination was suspended are removed. The commission’s decision will be validated by order of the minister of justice and could be challenged by potential beneficiaries of financial compensation in court.
The law on the rehabilitation of victims of offenses of July 29, 2016 provides that compensations equal to 70% of the calculated damage will be provided to the victims from the state budget, but not more than 10 official average salaries forecast for the year when the offense victim submitted the application. The compensation will be provided by the state if the resources of the one that committed the offense are not sufficient for covering the caused damage or if the damage cannot be compensated from other sources, like insurance and indemnities.
