Value of confiscated goods to be returned by State via special regulations
The value of the confiscated goods or the payment of compensations to the persons that were subjected to political repressions, as well as the compensations in the case of death resulted from political repressions will be paid by the State through a special regulation. It will be approved by the Parliament, following a recent approval from the Cabinet.
The regulation prescribes that the citizens of Moldova, subjected to political repressions and those who were further rehabilitated will be given back at their request or request of their inheritors the confiscated and nationalised goods or those taken out of their possession according to the law on the rehabilitation of the victims of political repressions. In case the confiscated goods can not be returned, their value will be paid by means of compensation following a claim submitted by the rehabilitated persons or their inheritors.
The claims shall be submitted to the committees specially created by the public authorities in raions, municipalities, and Gagauzia, in the settlements where the rehabilitated persons lived before the oppression.
Other documents which shall be attached to the claim are identity papers, the rehabilitation decision, documents which certify the confiscation, documents that confirm family ties and a certificate confirming that the persons did not receive compensations or the goods were not given back previously.
The request should be submitted within 3 years after the claimant was announced about the rehabilitation and shall be examined within 6 years after the claim was submitted.
Although the mechanism by means of which the value of the goods will be evaluated is not established yet, the regulation stipulates that if their value is smaller than MDL 200 thousand, the payment of the compensation can be spread out for a period of 5 years. In case administrative-territorial authorities will not have sufficient financial resources, the decision of the special committee will be forwarded to the Ministry of Finance that will decide within one month whether the compensation will be paid from the State budget.
The unique compensation for each dead or killed person worth MDL 540 will be paid from the budgets of the territorial-administrative units of first level and the municipality of Chisinau in monthly instalments within two months after the decision is approved.
