Lawyer of the head of “Moldova Noastra” Alliance (AMN) Serafim Urecheanu will submit to the general prosecutor the request to initiate criminal proceedings against the persons responsible for non-fulfillment of the decision of the Extended Board of the Supreme Court of Justice (SCJ). Another request petitioning against non-observance of the legislation will be submitted to the European Court of Human Rights (ECHR), MP of AMN Ion Plesca told a press conference held on Wednesday November 15. During the conference, AMN leaders stated that the Centru District Court violated the law when it reinitiated proceedings in the “ambulances’ case” According to Ion Plesca, on May 17, the SCJ Extended Board traced gross violations of the Code of Penal Procedure and European Convention on Human Rights. The Court decided to annul legal actions against Serafim Urecheanu, inclusively: beginning of legal actions against him; application of interdiction to leave the country; formation of a legal action group. Through the same decision, the general prosecutor was obliged to drop charges against AMN leader. On November 13, a panel of judges decided to initiate proceedings without taking into account the named decision, which is a “gross violation of legislation”, Plesca said. Serafim Urecheanu declared that the case of ambulances is a political one, initiated at the direct orders of President Vladimir Voronin who usurped the state authority. Urecheanu stated that he will appeal to the ECHR, not for protecting his rights but of Chisinau residents and citizens of Moldova. AMN made an appeal to the embassies and representatives of international organizations warning that the phenomenon of forging politically ordered cases became a dangerous occurrence in Moldova, as the prosecutors themselves brazenly violate constitutional rights of the citizens. Serafim Urecheanu is accused of embezzlement when purchasing 40 ambulances in 2003. A number of MPs and representatives of the civil society qualified this case as a political order. CoE officials have repeatedly urged the Chisinau government to abstain from such actions. The trial against Urecheanu will start on November 28 at 8.30 am.
