Ukrainian company claims 22m lei from Termocom
A Ukrainian company unjustifiably claims 22 million lei from Termocom and demands implementing by force a decision passed by a Kiev court, the heat supplier’s director Mihail Cernei announced Monday, Info-Prim Neo reports.
Mihail Cernei explained that the January 13 decision issued by the Economic Court of Kiev gives the Ukrainian company Komstroi the right to claim 22 415 509 lei from SA Termocom and IM Infocom. “On January 14, 2005, the claimed sum was levied from SA Termocom and IM Infocom in favor of SA Moldindconbank BC, under a decision pronounced by a Ukrainian court. The judge was the same in both of the cases,” said Cernei.
Mayor of Chisinau Dorin Chirtoaca said these acts are banditry attacks that could not take place without the involvement of persons and institutions from Moldova, businessman Platon (Veaceslav Platon, former AMN lawmaker), Moldindconbank, and certain judges. In 2006, SA Moldindconbank BC asked the Economic Court of Appeals to recognize the decision issued by a Kiev court in 2005. Afterward, the Supreme Court of Justice rejected this application, arguing the decision was taken with serious violations. In 2010, by a decision passed by the same Ukrainian judge, the application of Komstroi to be entitled to levy the 22 million lei from SA Termocom and IM Infocom was turned down. But in 2012, the same judge accepted the Ukrainian company’s application to claim money.
