Two lawyers declare themselves persecuted by prosecutors

Lawyers Veaceslav Turcan and Maxim Belinschi say that, although they have been acquitted in June, in the criminal case initiated in 2016 "for a supposed misrepresentation", they are still persecuted. They are required to pay one hundred thousand lei as moral damages.

At an IPN press conference, Veaceslav Turcan stated that, together with Maxim Belinschi, during the court representation of the interests of some persons dispossessed of inheritance by a former Balti police officer, they found fraudulent and false elements in the documents. The lawyer states that he asked the Prosecutor's Office to establish the circumstances of the case and to hold those who falsified documents to account. On the other hand, the former policeman lodged a complaint with the Prosecutor's Office in Râșcani, alleging that they presented false information.

According to Maxim Belinschi, on December 23, 2015, prosecutor Sergiu Railean, from the Prosecutor's Office of Râșcani district, in violation of the law and international standards that provide guarantees for lawyers, initiated the criminal prosecution, charging them with the "misrepresentation " offense. The lawyer argues that although complaints have been filed against the prosecutor's actions with the Prosecutor General's Office, including the former Prosecutor General at that time, Eduard Harunjen, they have considered the accuser's actions to be legal.

The lawyers also said that, shortly, the criminal case in which they appeared as accused was sent to the first instance court. The court admitted the defence’s' request, which asked the Constitutional Court to lift the exception of unconstitutionality of some provisions of the Criminal Code. Then, followed the rulings of all the other courts that they cannot be prosecuted, and on June 3, prosecutor Victor Rauh from Râșcani issued the order to drop criminal charges brought against the lawyers, requesting the court to issue a sentence to dismiss the criminal case.

The lawyers claim that they were convinced that the case was over, but shortly the same prosecutor, Victor Rauh, contested the acquittal judgment, requesting the issuance of a sentence to stop criminal prosecution for non-rehabilitation, but asked for one hundred thousand lei as moral damages to be collected from lawyers for the "so-called injured parties".

Alexandru Pagu, one of Veaceslav Turcan’s and Maxim Belinschi’s lawyers, mentioned that the charges brought against his colleagues were illegal, the lawyers cannot be authors of this crime.

The defendants ask the Prosecutor General's Office to evaluate the professional training of prosecutor Victor Rauh and to initiate a criminal case regarding prosecutors who have been in charge of the criminal case initiated against them and who supported the prosecution in court.
