Experts of the Center for the Analysis and Prevention of Corruption (CAPC) expressed their concern about two bills. According to the NGO, the lawmakers adopted them in a hurry in first reading, without examining them thoroughly, but the bills contain a lot of mistakes, Info-Prim Neo reports. The documents include the bill on the implementation of the one-stop office principle in the entrepreneurial sector and the bill on the regulation of entrepreneurial activities by authorization. “I don’t think there is ill will, but the bills should be amended and improved. They were probably drafted by persons who have not dealt much with legislative techniques, but more with economics,” CAPC head Galina Bostan told a news conference on Thursday. According to Galina Bostan, the informative note to both of the bills contains insufficient arguments, does not contain reference to the corresponding regulations of the EU and information about the economic and financial bases, does not analyze the compatibility of the bill with the existing regulations and its impact on the entrepreneurial activity, and does not ensure the observance of the rights and interests of the entrepreneurs and the state. Galina Bostan said the formulations included in the bill on the implementation of the one-stop office principle do not meet the conditions laid down in the law on legislative documents. “The norms are not expressed correctly, concisely and equivocally and should be read for several times to be understood,” she stated. One of the problems that this bill may cause resides in the possibility of the public authorities signing cooperation contracts with a private organization. Under the bill, if the authorities must set up a one-stop office, but are unable to, they can sign a cooperation contract with a private firm to make the procedures for regulating the entrepreneurial activity through this method more efficient. “It is presumed that there will be an intermediary between the people and the authority. What is the use of such a move if the time spent by the authorities with the intermediary can be spent to communicate with the people. Furthermore, this intermediary will definitely be a relative or friend of the authority,” said Galina Bostan. As to the bill on the regulation of entrepreneurial activities by authorization, the CAPC head said a lot of economic entities lost time and effort when trying to obtain licenses, permits and authorizations from the local public authorities. “I don’t know why the authors of the bill did not scan all the related normative documents so as to ease interaction between the entrepreneur and the local public authorities. It is a serious shortcoming,” said Galina Bostan. She also said that before being passed in final reading, the bills must be thoroughly examined by all the ministries and specialists in the field as well as the legislative body, while the authors should be more diligent. This expertise was realised by implementing the project “Coruption Proofing of Draft Legislative Acts – Phase V”, financed by Civil Rights Defenders and Swedish International Development Cooperation Agency.
