Transnistria's draft constitution, submitted to breakaway Justice Ministry
The committee charged with drafting a new Transnistrian Constitution has ended to consider the draft and sent it to the Justice Ministry of the self-styled republic, Info-Prim Neo's correspondents reports from Tiraspol.
According to the constitution in force, the republic is presidential. The Tiraspol leader is a head of the state, a guarantor of the Constitution and is atop of the executive power branch.
According to Tiraspol justice minister Sergei Stepanov, this creates a double situation. The new draft establishes that the Transnistrian leader won't stay in front of the executive power. Those powers will be attributed to the head of the Cabinet. However, the President will still be able to endorse the cabinet's structure and will control its members, said the Transnistrian official.
The draft borrows a lot from the Russian Constitution. The differences, according to
Stepanov, consist in the right of the Transnistrian president to dissolve the government and sack ministers. He also will be entitled to appoint and dismiss heads of state administrations, to call elections and referendums, to dissolve the legislature.
Annually, the Transnistrian leader will report to the legislature on the economic and political situation, on the vectors of the domestic and foreign policies. In case of failing to carry out his duties, his powers will be temporarily rendered to the government's head.
The president may be dismissed if found guilty of offense, as the decision shall be adopted by the higher chamber of the Parliament, by 2/3 of votes.
The draft is posted for debates on the Justice Ministry's site www.minjust.org. It will then be endorsed through a referendum.
