There are sufficient reasons for initiating impeachment procedure, expert

University professor Nicolae Osmochescu, resigned judge of the Constitutional Court, said Igor Dodon, since he was elected President of the Republic of Moldova almost two years ago, repeatedly violated the Constitution and there are sufficient reasons for initiating the impeachment procedure.

In an interview for Radio Free Europe that is quoted by IPN, the expert said that if abiding strictly by the content and letter of the Constriction of the Republic of Moldova, the President can be suspended from office whenever need be as the Constitution clearly says how many times this can be done. But this stipulates that he can be suspended when he avoids fulfilling his constitutional duties. And there is a concrete case when he avoided performing a duty that he was obliged to perform – to appoint the candidates who were fielded by the government for ministers for two times.

“This is the positon of the President, but it is not correct as the Government is absolutely legitimate. It was invested by an absolutely legal Parliament that was elected constitutionally by the people. We do not speak about the quality of Parliament. We speak about the election procedure. So, the Government is absolutely legal, regardless of the hour when it was invested and by what groups of Parliament,” the expert explained.

Nicolae Osmochescu said that if the President needs to be subject to impeachment for his statements and the violations committed during these almost two years, the procedure should be initiated. But the government, hiding behind political pretexts, says it is not the right context and moment. “I’m firmly convinced that the initiation of an impeachment procedure in this case will be to the detriment of the parliamentary majority and the parties that form part of the parliamentary majority and will advantage the Party of Specialists and Mister Dodon personally in the upcoming elections,” stated the ex-judge.

Nicolae Osmochescu believes that the President will be yet suspended from office until the mandate of the current Parliament expires given that a series of laws with which Igor Dodon does not agree are to be promulgated. He will use his relative right of veto and will not promulgate them and will send them back to Parliament.
