The human rights situation on the left bank of the Dniester remains without due attention, report

The human rights situation in the Transnistrian region of the Republic of Moldova remains without due attention from the relevant constitutional authorities and international institutions. The population of this territory remains practically without access to lawful and effective legal instruments for human rights defense - it is shown in a report on the impact of Russian troops in Moldova, Ukraine and Armenia on the human rights situation, drawn up by Promo-LEX Association in Moldova, Helsinki Citizens' Assembly-Vanadzor from Armenia and the East Europe Research Initiative Foundation from Ukraine, IPN reports.

According to a Promo-LEX Association press release, the interest in this subject in the Republic of Moldova has increased due to the numerous cases of human rights violations in the Transnistrian region, many of which are forwarded to or examined by the ECHR. Even though decisions were rendered in 58 cases, with over two thousand people being recognized as victims of human rights violations and abuses by the administration in the region, the situation continues to be ignored. The Russian Federation avoids the execution of the ECHR Decisions and the payment of the cumulative amount of about 5.5 million euros, Promo-LEX says.

In the statement made by the association, it is mentioned that "the national mechanisms for the protection of human rights, implemented at international level and available to constitutional authorities, have a small impact here, although under the Universal Periodic Review Moldova has accepted several recommendations regarding the respect of human rights in the Transnistrian region”. "In particular, attention was focused on the promotion of human rights and the development of a mechanism to monitor the situation, involving the representatives of civil society from both banks of the Dniester"

According to Promo-LEX, "under these circumstances, the phenomenon of impunity, the lack of any possibilities for monitoring the situation and the lack of any guarantees for the respect of human rights are elements that characterize the real situation regarding the state of human rights on this territory."

The authors of the report identified a number of factors that favor the perpetuation of the situation and examined the impact of Russian troops on the events in the analyzed conflict zones. The authors described the process of the Moldovan-Russian negotiations on the terms and the withdrawal of Russian troops from Moldova. This was done to show how it was possible for the Russian Federation to obtain the status of guarantor and mediator in the process of political negotiations, under the conditions of maintaining its military presence and in spite of the fact that, according to the Constitution, the Republic of Moldova is a neutral state and does not admit the presence of foreign troops on its territory, says Promo-LEX.

The statement says that the authors have also analyzed how the Russian presence in Moldova contributed or favored the infringement of human rights, and in some situations the Russian military were the ones who committed direct violations of the rights of the inhabitants of the region. "The report's authors argue that the presence of Russian troops and the human rights situation in the Transnistrian region of the Republic of Moldova should be a priority in the bilateral dialogue of the Republic of Moldova with the Russian Federation, as it is actually key to settling the Transnistrian issue. At present, these topics are only occasionally addressed, remaining in the shadow of others; they are not debated in the public space or are discussed in a non-transparent manner”, mentions Promo-LEX.
