Termocom management fears another 'raider attack'

Just after the Komstroy case, another foreign company called Caldon Holdings Ltd is claiming money from Chisinau's heat and hot water utility Termocom in what the latter labeled “another raider attack” against the company, Info-Prim Neo reports. The sum involved is nearly 32 million lei that the utility allegedly owes under a surety agreement. In a press release, Termocom called the debt “unjustified”. According to it, the Edinburgh-based Caldon Holdings Ltd. and the Ukrainian company Komstroy signed a surety agreement whereby the former committed to settle all Termocom's liabilities owed to Komstroy. After Moldindconbank transferred the right to recover 22.4 million lei from Termocom's and Infocom's accounts, under a decision of the Kiev Economic Court, a new surety agreement was signed which unjustifiably increased the liability to 31.8 million lei. The Economic District Court examined the Caldon Holdings Limited's claim for 31,827,764 lei from Termocom and rejected it by an irreversible and unappealable decision. At the same time, Termocom's appeal against the Kiev Court's decision was also rejected by the Kiev Appellate Court. Termocom has said it will ask the Moldovan authorities for help to resolve this “unjustified claim”.
