Supreme Council of Magistrates postpones examination of case of Nogai

The Supreme Council of Magistrates Tuesday decided to put off the examination of the case of judge Nicolae Nogai, who faces dismissal Minister of Justice Oleg Efrim, who filed the disciplinary suit, considers that the decision to postpone the trial was taken too easy, Info-Prim Neo reports. After deliberations, the members of the Council said they took such a decision because Nicolae Nogai did not come to the hearing, but sent a justifiable challenge. They also said they need more time to examine all the aspects of the issue. In the hearing it was announced that Nicolae Nogai did not present himself because he has to try a series of very ‘resounding’ cases. ”I, as a member of the Supreme Council of Magistrates who instituted the disciplinary proceedings on October 7, wasn’t informed about a possible postponement. It seems to me that the Council took the decision to put off the examination of this case too easy,” Oleg Efrim told the press. ”I doubt it that a magistrate who is close to being dismissed decides to remain and judge cases and does not come to defend his cause, though he filed a challenge. Despite the presumption of innocence, such a state of affairs stains the legal system and contributes to reducing the people’s confidence in justice.” Earlier, the prosecutor general asked withdrawing the immunity of the Bender Court of Appeals judge Nicolae Nogai so that he could be prosecuted. The judge is accused of legalizing the sale of a shareholding of Moldova Agroindbank. Afterward, the Supreme Court of Justice ordered returning the shares to the value of about €40 million to the group of Slovenian and Dutch shareholders.
