The Socialist MPs on October 26 will come to Parliament with a legislative initiative to ban judges of the Constitutional Court (CC) from holding dual nationality, IPN reports.
In a news conference on October 23, MP Vlad Batrancea explained it is not normal for six citizens who swore an oath of allegiance to another state and have a foreign passport in the pocket to decide the fate of the Republic of Moldova. The MP made reference to the CC judgments of October 17 and 20, saying the Constitutional Court by these substituted the role of the President.
Vlad Batrancea said the legislative proposal contains amendments to the Penal Code, the Law on the Constitutional Court and the Code of Constitutional Case Law by which the candidates are barred from holding the post of CC judge if they have dual nationality. The Socialists also intend to propose amendments to the Penal Code so as to simplify the procedure for holding accountable the CC judges for violations of the Constitution, abuse of power and usurpation of the power in the state.
“When the judges of the Constitutional Court take decisions by which they remove the President elected by the people, this is usurpation of the power in the state. The Penal Code should be amended so that any judge who commits such acts is held criminally accountable,” stated the MP, noting that the CC now no longer safeguards the interests of the Constitution as it promotes the interests of one party.
On October 17, the Constitutional Court ruled that the President of Moldova has the right to check the compliance of the candidate proposed by the Prime Minister for a post, but does not have the right of veto against this candidate.
