Sergiu Litvinenco: A prosecutor general could be named by winter

A prosecutor general chosen at a contest held by the current composition of the Superior Council of Magistracy could be appointed by the end of this year, said Minister of Justice Sergiu Litvinenco, noting that the term in office of acting proseutor general Dumitru Robu expires this Octover. The minister stated that the next prosecutor general can be a foreign citizen as the law permits this, IPN reports. 

Sergiu Litvinenco said that a bill is now designed to
enable to fill the post of prosecutor general after the term in office of the acting prosecutor general Dumitru Robu expires. As the Stoianoglo case is not expected to be solved soon, the term of Dumitru Robu will be extended or a prosecutor general will be named for a definite period of time.

“The bill was drafted based on the conclusions of the Venice Commission of December 2021. We do nothing but adjust the legislation to the opinion of the Venice Commission. The problem will be addressed and the final law could contain a solution. There are a number of solutions. The term of the acting prosecutor general can be extended or a new prosecutor general can be named for a seven-year term, but this could be removed if the former prosecutor general is reinstated. It can happen so in the case of civil servants,” Sergiu Litvinenco stated in the program “Black Box” on TV8 channel.

According to the minister, if a new contest is held, the Superior Council of Magistracy will launch the pre-selection procedure and President Maia Sandu will name the new prosecutor general.

“When the Council decides to start a contest, time is given for all those who meet the criteria. The contest is held and a decision is taken and transmitted to the President for confirmation or rejection. The appointment of a prosecutor general by the current composition of the SCP is possible. We can have a prosecutor general by winter. The conditions for the post of chief anticorruption prosecutor are valid for the post of prosecutor general too. The law envisions the possibility of naming foreigners who have appropriate experience in the country and abroad,” stated the minister of justice.

Dumitru Robu took over the post of prosecutor general on October 6, 2021. The appointment decree was signed by President Maia Sandu after Robu was proposed for the post by the Superior Council of Magistracy.
