The rights of female inmates with children are violated, concluded ombudswoman Tamara Plamadeala after visiting the Balti-based Penitentiary no.13. She said in particular the female inmates are denied the right to see their children regularly, while the lack of money makes it difficult for them to hire lawyers, whose fees start from 5,000 lei.
The ombudswoman also says many inmates complained that when they were sentenced they hadn't been asked if they had minor children and who would look after them. Some imprisoned women said they didn't know where their children were and how to find them after serving their sentences.
Tamara Plamadeala expressed her deep regret that there are woman sentenced for human trafficking, in the absence of reasonable suspicions, and who didn't have the capacity and skills to prove their innocence.
The ombudswoman was told in the Balti penitentiary that lawyers fail to visit their clients in prison, do not confer with them, do not collect evidence and show up only on the day of the trial, where they fail to produce adequate evidence to establish the causes, the innocence or the quilt of the defendant.
Last year some female inmates with children were pardoned, and the ombudswoman think it is unfair that the amnesty didn't cover the male prisoners who left behind unsupervised children as well.
“Taking into considerations the problems discovered, I will submit a request to the Minister of Justice and the Superior Council of Magistrates to issue regulations for the judges, who must consider and respect the right to a fair trail and to the examination of internal dossiers”, stated Tamara Plamadeala, referring to the intention of introducing legal modifications that would also take into consideration the parental rights of imprisoned fathers.
Ombudswoman Plamadeala said she would make trips to see for herself how inmates' children live and who takes care of them. Additionally, a meeting of the Lawyers' Union will be called to find ways of penalizing the lawyers who disregard their obligations.
