Right to property in Moldova is seriously violated because of population’s juridical illiteracy – experts

The right to property is seriously violated in the cases of victims of political repressions and the lawsuits on the retrocession of nationalized properties are moving very slowly, Ion Manole the head of “Promo-Lex” Association declared. According to the quoted source, the jurists of the association defend in court the ex-deported persons, who are aged over 80 at the moment and participate in lawsuits which last more than 5 years, asking for the retrocession of nationalized properties. The age of the victims of political repressions diminish their chances to “repair” the violated rights. According to Manole, the cases when the courts remit for 3-4 times the cases for reexamination are numerous and because of laws’ imperfection, judicial bodies treat differently the cases on returning property. The expert states that the right to property is also violated when legislation on expropriation for public utility is applied incorrectly. The head of “Promo-Lex” says that such mistakes happen because of the juridical illiteracy of the population. The population’s level of juridical knowledge is very low, the quoted source states. This fact is confirmed by jurists who discuss with the persons soliciting to defend their rights. Ion Manole says that farmers also do not know their rights and because of this fact they confront with many problems in every locality concerning the assigning and using of nationalized properties. A thorough research regarding the right to property as well as the situation of other human rights in Moldova in 2005 is included in a Report of “Promo-Lex” Association, launched this week in Chisinau.
