Republican Association of War Participants and a businessman dispute a plot near the historic zone of Chisinau

The local authorities of the capital sold a plot in the historic zone of Chisinau, which previously was given to the Republican Association of Wars Participant of Moldova (ARPRM). ARPRM chairman Vasile Zaiat shows the illegality of the transaction against the fact that the plot is disputed for a long time. Zaiat stated on Wednesday press conference that on 4 July 2002, the Municipal Council has given this plot to the Association situated between the streets Moara Rosie, Buna Vestire and Colina Pushkin for construction of some apartment blocks for about 75 families. To this address, street Moara Rosie 5A, there were 5 buildings for demolishing. On 4 March 2003, the Chisinau Territorial Cadastre Office (OCTC) has registered those 5 buildings on “Santuan” JSC, thing that determined ARPRM to address the court. The Administrative College of the Supreme Court of Justice, according to the copies of the documents and non-presence of ARPRM representatives, adopts, on 27 October 2004, a decision through which obliges the local authorities to sell the plot to SA “Santuan”, leading this way to a long-term conflict. In July 2005, Chisinau prosecution requires the local authorities not to make any transaction with the plot near the buildings on the street Moara Rosie 5A, but in September 2005, CMC adopts a decision and concludes a selling-buying contract with „Santuan”, and OCTC, in 3 days only, issues the owning title of this plot. According to Zaiat, at the moment, SA “Santuan” is selling this plot, of 0.84 hectares, at the price of EUR 1,5 million. On Tuesday, ARPRM addressed an open letter to President Vladimir Voronin, requesting his involvement in solving this conflict. Zaiat noted that in case they do get justice in RM, the Association would appeal to the European Court of Human Rights. According to him, the veterans live in very difficult conditions, in homes, basements, rent apartments, determining them not to cede and to seek their justice in Strasbourg. The head of the Constructions, Architecture and Land resources Commission of the Municipal Council, Eduard Smirnov, said that even if it is hard for him to remember of any CMC decision, he considers that the councilors took the decision in favor of “Santuan” in light of the court’s sentence. At the same time, he considers that the decision is fair, since “Santuan” is the owner of those 5 buildings situated on the land on the street Moara Rosie 5A. At their turn, ARPRM representatives highlight that, pursuant to this conflict, the Administrative College of the Supreme Court of Justice took an illegal decision according to fake documents presented by SA “Santuan”.
