The total amount of compensation paid last year under mandatory internal motor third-party liability insurance (RCA) contracts exceeded 487 million lei. Nearly 485 million were compensations paid for property damages, and 2.6 million lei were compensations for health damages, representing 0.55% of the total compensation amount.
In a response to IPN, the National Commission for Financial Markets specifies that last year, compensations for health damages were paid in 119 cases.
To request compensation, the injured party submits the claim to the RCA insurer or the National Bureau of Motor Insurers (BNAA). The form and content of the compensation claim are standardized for all RCA insurers and can be consulted on the CNPF website.
To reimburse expenses for medical services not covered by mandatory health insurance funds, supporting documents confirming these expenses must be presented, such as payment receipts and medical prescriptions for the appropriate procedures.
The insurer must also be provided with other documents confirming any expenses generated by the accident, including costs for transporting the injured person, prosthetics, rehabilitation, care, and special diet costs as prescribed by medical recommendations.
If bodily injuries resulted in loss of income, additional supporting documents must be presented. For individuals who are not employees, documents confirming the average net monthly income declared to the competent institutions for the last 12 months must be submitted. For injured persons who are neither employees nor self-employed, such as students, documents confirming the minimum consumer basket amount for the period of temporary incapacity to work must be provided.
If the road accident resulted in death, dependents of the deceased who were entitled to maintenance pension from the deceased must submit supporting documents confirming the average net monthly income and the allowance received from the state social insurance budget.
A person who suffered an accident on the territory of the Republic of Moldova submits the compensation claim to the National Bureau of Motor Insurers if it is established that the driver failed to fulfill the obligation to conclude the mandatory RCA insurance contract or if the vehicles are unregistered or were not registered on the territory of the Republic of Moldova. The same applies if the vehicle or its driver remains unidentified or if the vehicle was obtained illegally.
The amount of insurance compensation is determined based on an agreement concluded between the injured person and the RCA insurer. If the parties fail to reach an agreement, the RCA insurer pays compensation in the determined amount, and the injured person has the right to challenge the insurer's decision in court.
The legislation provides that mandatory RCA insurance covers liability for damages caused by vehicle accidents to all persons other than the driver at fault. Family members of the vehicle's driver are not excluded from benefiting from insurance for their own bodily injuries.
As a general rule, if the guilty driver's spouse dies in the accident, provided that the driver obtains the status of successor, they may claim the compensations that the spouse would have been entitled to receive as an injured person.
