Rascani Court judge accused of raider attack
The judge of Rascani District Court Igor Vornicescu is accused of staging a raider attack by passing a decision to expropriate the building of a company, in breach of an ECHR decision, Info-Prim Neo reports.
“The case involves CHRIS SRL. It has been examined since 1998. In 2009, the ECHR ruled in favor of Misses Eugenia and Doina Duca. Based on the decision of the High Court, the Supreme Court of Justice confirmed that the building belonged to them. But these decisions have not been yet implemented. As many as 48 legal cases were started against Eugenia and Doina Duca with the aim of expropriating their property,” Teo Carnat, executive director of the Helsinki Committee for Human Rights of Moldova, said in a news conference.
According to him, despite the decisions passed by the ECHR and the Supreme Court of Justice, on August 22, 2011 judge Igor Vornicescu accepted to examine an application from the Andoni couple – former employers of CHRIS SRL - and decided in their favor. “By that decision, Eugenia and Doina Duca were deprived of 76% of the building that belonged to the company. In 2002, the same judge complained that the Andoni couple threatened him. But in nine years, he pronounced a decision whereby Eugenia and Doina Duca were expropriated,” said Teo Carnat.
He also said that it was a raider attack. “It is a shocking case that endangers the whole judicial system and the system of the law enforcement bodies as the state bodies are used in the interests of certain persons who want to achieve certain goals,” stated Teo Carnat.
Doina and Eugenia Duca founded CHRIS SRL and owned a building to the value of about €1.5 million on Grigore Vieru St. Iurie and Sofia Andoni worked for CHRIS SRL and came into possession of 51% of the company’s capital.
