Public procurement could become more transparent
The Government approved the amendments to the regulations concerning the compilation of the prohibition list for economic operators formulated by the Ministry of Finance. The amendments are aimed at making the participation of the economic entities in public procurement more transparent and efficient, Info-Prim Neo reports.
This prohibition list is an official document drawn up by the Public Procurement Agency that limits the economic entitles' participation in the procurement process to a three-year period if they did not respect the conditions of the purchase contracts or violated the legislation on public procurement.
“The regulations define the violations for which the economic entity is included in the list, but does not say how the companies are removed from it,” said Minister of Finance Veaceslav Negruta.
The amendments allow the inspection bodies to ask that the economic operator be included in the prohibition list and to provide evidence showing that the company did not appropriately fulfill the contractual obligations assumed as part of the public procurement procedures.
They will also enable to objectively and quickly examine the documents presented by the contracting authority and the economic operator when the latter runs the risk of being included in the prohibition list.
The Public Procurement Agency is obliged to notify the parties of the decision taken within five days of the day when the decision is made. It also must publish the modified prohibition list on its official website ww.tender.gov.md.
