Public consultations will be held on new Land Code bill

Public consultations on the new Land Code bill will continue until the end of this month. The project is published on the government platform particip.gov.md.

The project aims to decentralize roles in the field of land relations. The information from the Land Cadastre, currently kept on paper, is proposed to be introduced in an automated information system. The executive branch has yet to approve the concept. The land registry will interact with other registers and will be updated every four years.

The new Land Code bill identifies solutions for the issues that arise when land is transferred from national public authorities to local public authorities, when the destination of the land is changed, when the exploitation of technological roads located on agricultural land occurs and aims to solve issues related to constructions allowed on agricultural land.

Several provisions refer to land that is not processed. If the land is in an unsafe phytosanitary state for more than two years, the local governments will be able to arrange the lease of the land. The owner will be notified. If there is no reaction from the owner within 3 months, the local public authority could lease the land for a period of 5 years. However, the owner will preserve property rights.

State control over land use and protection, according to the project, will be carried out by the government via the Environmental Protection Inspectorate.
