The MPs of the Socialist Party filed a requisition with six questions to the Constitutional Court, requesting it to say what is the time limit by which the President must nominate a candidate for Prime Minister and what penalties the President faces for not meeting this time limit, IPN reports.
In a news conference, MP Vasile Bolea said they acted so because the President does not take steps and perpetuates the governmental crisis. “The President’s refusal or delay in nominating a candidate for Prime Minister goes against the Constitution. What are the consequences if the President does not propose a candidate for premiership during the general period of three months?” stated Vasile Bolea.
The CC is also asked to clarify the consequences if the President nominates the candidate for Prime Minster by ignoring the period of 45 days of the first nomination and if the second candidate is not proposed when the first candidate is rejected.
Another question is if the impossibility of forming a government during three months as a result of the President’s refusal to provide a candidate for Prime Minister is a reason for dissolving Parliament. “What is the consequence if the President, as a result of consultations with the parliamentary groups, considers there are yet real chances for investing the government through the current Parliament, but the period of 45 days expired?” is another question put by the PSRM.
Vasile Bolea noted the President should have a pro-active position and should be a mediator, not a person who plays the political game of a parliamentary group or party.
