The prosecutors will be banned from pronouncing in public on an irrevocable court judgment. This is provided in the new Prosecutor’s Code of Ethics and Conduct that was adopted in the General Assembly of Prosecutors on May 27, IPN reports.
According to acting prosecutor general Eduard Harunjen, the situations when irrevocable judgments are discussed in public must be anticipated. It was thus decided to create a clear mechanism for removing them. “I think that when the prosecutors publicly analyze court decisions, great harm is done to the image of the court and its personnel,” he stated.
The president of the Supreme Council of Prosecutors Mircea Rosioru said an irrevocable verdict is a law and must be accepted no matter whether the prosecutors like it or not.
The Code of Ethics defines the mandatory professional ethics standards and principles and norms of conduct of the prosecutors while on duty and in the private life. Thus, the prosecutors must do their job independently, impartially, honestly and irreproachably, showing high moral standing and maximum correctness. They must also be autonomous when taking decisions and must not form part of parties or sociopolitical organizations.
The Code stipulates that the prosecutor will not fulfill the instructions or requests of politicians, state functionaries and representatives of rule of law institutions if these run counter to the legislation, other regulations or the principles of the Code of Ethics.
The Prosecutor’s Code of Ethics and Conduct takes effect on August 1 this year, simultaneously with the new Law on the Prosecution Service that was passed by Parliament in February.
