A prosecutor of the Chisinau Prosecutor’s Office is accused of abuse of power when investigating a very serious crime. According to investigators, the prosecutor abused his authority when he was transmitted for execution the rogatory commission requests formulated by the authorities of the Netherlands over a robbery committed by a Moldovan in Winterswijk town, which resulted in the death of a person. The criminal case started against the prosecutor was sent to court, IPN reports.
According to the Prosecutor General’s Office, the prosecutor, managing the prosecution group for investigating the case, hid electronic devices with recordings of telephone conversions made during special investigation measures. These reveal that the prosecutor was influenced to favor the situation of the accused by excluding a count. Realizing that he could be investigated for acts of corruption if the recordings become known, the prosecutor didn’t present them to the judge of inquiry.
It was also established that the prosecutor hushed up the conclusions of experts and the legal assessments of the Dutch authorities. He excluded the count of intentional murder from the indictment and sent the case only over robbery to court.
Afterward, another state prosecutor withdrew the case from court in order to modify the indictment and include the count of intentional murder. As a result, the culprit was found guilty and was sentenced to 20 years in jail.
The case was remitted to the Rascani Court for examination. The ex-prosecutor faces a fine of up to 40,000 lei or up to six years in jail. In both of the cases, he will be banned from holding particular posts or performing particular activities for a period of five to ten years.
