Prosecution against doctor accused of malpractice resumed

Prosecutors restarted the investigation into a case of malpractice that involves the head of the Obstetrics Section of the Telenesti District Hospital. The doctor is accused of neglect of the rules of providing medical assistance during labor. In a communique, quoted by IPN, the Prosecutor General’s Office says the medical-legal examination revealed a direct connection between the medical-surgical errors and the unfavorable consequences for the mother and fetus.

The case happened in the maternity ward of the district hospital in January 2012. A patient that was 39 weeks pregnant was admitted to the hospital following the premature rupture of fetal membranes in the amniotic sac. During the premature birth, the child sustained a clavicle fracture, while the mother suffered complications. The woman underwent several surgeries during which her uterus and cervix were removed. Later she also remained without a kidney.

In their conclusions of December 2012, Moldovan experts showed that the doctors who assisted the delivery bore no blame for the developments. These consecutions were upheld following a repeated medical examination performed also in Chisinau in January 2014. As there was no evidence to prove the blame of the doctor, the charges were dropped.

To elucidate the case, in 2014 the prosecutors sought assistance from the Romanian judicial authorities in performing an international examination. Recently, the Romanian experts showed there was a direct connection between the consecutive medical-surgical errors and the unfavorable consequences for the mother and fetus, noting a cesarean was needed in this case.

The doctor faces up to three years in jail and could be also banned from performing particular activities or holding particular posts for a period of up to five years.
