The mandatory notarial authentication procedure when registering real estate transactions could be eliminated, while the procedure for registering the ownership rights with the Agency for Land Relations and Cadaster could be simplified. The parliamentary group of the Liberal Democratic Party of Moldova registered a bill to this effect, IPN reports.
According to a press release of the party, by making the notarial authentication mandatory, the state doubles partially or fully some of the elements of the registration procedure. Thus, of the three main duties of a notary – verification of the identity of the sides, information and control of the validity of the consent of the sides involved in a real estate transaction – only the last one is not doubled by the Agency for Land Relations and Cadaster. The bill provides that this duty should also be assigned to the Agency.
The bill authors said the amendments are aimed at ensuring a complex procedure managed by the Agency for Land Relations and Cadaster, which will include all the duties of a notary. These will also reduce the costs and time needed for registering real estate transactions, without affecting the ownership rights.
