Promo-LEX is calling for the deletion of the amendment to the Contravention Code which provides for the addition of a new article - Online disinformation. The association agrees with the Independent Journalism Center's opinion that "Article 704 is in total dissonance with the principle of clarity, accessibility and predictability of the law", IPN reports.
According to the Association, the proposals to add para. (3) to Article 52, which prohibits election campaigning, of the Contravention Code are premature and should be eliminated.
Similarly, Promo-LEX considers that the express introduction of the phrase "sexist speech" is not necessary, as it is already included in the definition of hate speech.
Promo-LEX monitoring from 2018-2024 shows that hate speech during election periods targets various groups: in the 2024 presidential elections, 57 cases of homophobic speech and 54 cases of sexist speech were identified. At the same time, between August-November 2024, 244 cases of hate speech affecting at least 18 different groups were documented.
