Pro Moldova suggests creating Anticorruption Court

The members of Pro Moldova group propose founding the Anticorruption Court, a new institution specialized in the fight against corruption. A legislative proposal on the creation of such a court was registered in Parliament today, June 19. Pro Moldova MP Sergiu Sîrbu voiced hope that the bill will be debated and adopted in the first reading as swiftly as possible, IPN reports.

According to Sergiu Sîrbu, the Anticorruption Court will examine all the cases of corruption, including the appeals. The judges of this court will be chosen in a different way. Besides the Superior Council of Magistracy, a council of international experts will be set up to help choose the judges not only from among representatives of the Moldovan judiciary, but also from among valuable human rights experts with an irreproachable reputation.

According to the MP, the acts of corruption are now examined by all the common law courts, of all the districts, but there is no specialization and a very good judicial practice and there are problems related to the real independence of the justice system. Only the fifth part of those convicted of acts of corruption serve time in jail. For most of them, the confiscation of the ill-gotten gains is not ordered. Many cases remain unexamined or are tried superficially by courts.

“We need an Anticorruption Court of the Republic of Moldova, which would help do a veritable reform of the justice sector,” stated Sergiu Sîrbu.

He noted that a new anticorruption strategy of Moldova was approved in 2016-2017 and this stipulates the necessity of creating specialized anticorruption institutions. But this wasn’t implemented.
